These Terms and Conditions ("Terms") govern your access to and use of the Monsnatch website, digital platforms, online services, community areas, downloadable content, and related offerings (collectively, the "Services").

By accessing or using the Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, you must discontinue use of the Services immediately.

1. Eligibility and Acceptance

You represent that:

• You are at least 13 years of age or the minimum legal age in your jurisdiction.
• You have the legal capacity to enter into these Terms.
• If you are using the Services on behalf of an organization, you are authorized to bind that entity.

2. Permitted Use

Subject to compliance with these Terms, Monsnatch grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes.

You agree not to:

• Reverse engineer, scrape, or exploit any part of the Services.
• Circumvent security measures or access restricted systems.
• Use the Services to misrepresent affiliation with Monsnatch.
• Conduct automated data harvesting without permission.
• Upload malicious software or harmful material.
• Use the Services in violation of any applicable laws.

3. Intellectual Property Rights

All content made available through the Services—including game mechanics, rulesets, artwork, illustrations, characters, storylines, card designs, packaging concepts, trademarks, logos, and audiovisual materials (collectively, the "Content")—are owned by or licensed to Monsnatch and protected under international intellectual property laws.

Nothing in these Terms grants you ownership of any intellectual property.

You may not reproduce, distribute, publicly display, modify, translate, or create derivative works without express written authorization, except where permitted by law for private, non-commercial use.

4. User Submissions and Fan Content

If you submit ideas, artwork, feedback, comments, designs, gameplay concepts, or other creative materials ("Submissions"), you grant Monsnatch a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, reproduce, adapt, publish, distribute, and display such Submissions in connection with the development, marketing, and operation of the Monsnatch universe.

You warrant that:

• You own or have sufficient rights to the Submissions.
• Your Submissions do not infringe third-party rights.
• Your Submissions are lawful and non-defamatory.

Monsnatch is under no obligation to credit or compensate for Submissions unless otherwise agreed in writing.

5. Products, Digital Goods, and Transactions

Where the Services include physical products, digital downloads, expansions, merchandise, or in-game items:

• Prices and availability may change without notice.
• Orders may be cancelled at Monsnatch's discretion.
• Digital goods are generally non-refundable once delivered unless required by law.
• Shipping timelines are estimates only.
• Import duties, VAT, or local taxes may apply.

6. Crowdfunding and Pre-Orders

Any crowdfunding or pre-order campaigns linked through the Services are governed by the policies of the hosting platform.

Production schedules, delivery estimates, and product specifications are subject to change due to manufacturing, logistics, regulatory approvals, or force majeure events.

Monsnatch does not guarantee timelines unless expressly stated in campaign materials.

7. Community Spaces and Conduct

Community forums, Discord servers, social platforms, or comment sections associated with Monsnatch ("Community Areas") must be used respectfully.

You may not:

• Harass or threaten others.
• Post unlawful or hateful content.
• Impersonate staff.
• Promote scams or illegal activity.
• Disrupt community operations.

Monsnatch reserves the right to remove content or restrict access without prior notice.

8. Third-Party Services

The Services may integrate or link to third-party websites, tools, or platforms. Monsnatch is not responsible for third-party content, functionality, or privacy practices.

Your dealings with third parties are solely between you and such providers.

9. Disclaimers

The Services are provided on an "as is" and "as available" basis.

Monsnatch makes no warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, Monsnatch shall not be liable for indirect, incidental, consequential, punitive, or special damages arising from or related to your use of the Services.

In no event shall Monsnatch's total liability exceed the amount paid by you to Monsnatch in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Monsnatch, its officers, employees, contractors, partners, licensors, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of:

• Your breach of these Terms.
• Your misuse of the Services.
• Your violation of third-party rights.

12. Suspension and Termination

Monsnatch may suspend or terminate access to the Services at any time, with or without notice, for conduct that it reasonably believes violates these Terms or harms the Monsnatch brand or community.

13. Modifications to the Terms

Monsnatch reserves the right to revise these Terms at any time. Updated versions will be posted on the Services and become effective upon publication.

Continued use after updates constitutes acceptance.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the applicable laws, without regard to conflict-of-law rules.

Any disputes shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force.

16. Entire Agreement

These Terms constitute the entire agreement between you and Monsnatch regarding the Services and supersede all prior communications or agreements.
